Website scope

These terms govern the FIX256 website, which describes our managed IT capabilities and provides ways to contact us. Use the website lawfully and review these terms. If you do not wish to use the website under these terms, discontinue use. Mandatory rights under applicable law remain unaffected.

Separate agreements for services

Visiting the website, submitting an inquiry, or requesting an assessment does not establish a managed services engagement or authorize work. Scope, pricing, licensing, support hours, response targets, onsite coverage, renewals, cancellation, billing, confidentiality, and liability are set in a separately executed agreement or statement of work. That agreement controls contracted services if it conflicts with these website terms.

An introductory conversation identifies needs and a possible next step. Technical assessments, system access, remediation, and projects require agreed scope and authorization. Marketing descriptions and illustrative timelines are not service level agreements.

Permitted use and account access

Submit accurate information and only information you are authorized to share. Do not impersonate others, spam forms, introduce malware, interfere with the website, probe systems without written permission, or attempt to access private business or client records. A sign-in or portal link does not grant access to another party’s account or information.

Administrative access is restricted to authorized users. Report security concerns to admin@fix256.com without including credentials or confidential client data. The public inquiry form is not an emergency helpdesk; existing clients must use their agreed support and escalation channels.

Content and intellectual property

FIX256 branding and original website content are protected by applicable intellectual property law. You may view content and make reasonable internal copies to evaluate services. Do not reproduce branding or imply endorsement without permission. Third-party marks belong to their owners; references do not establish partnership, certification, or endorsement.

You retain rights in information you submit and authorize its use as reasonably necessary to respond and administer the interaction, subject to our privacy policy and applicable agreements. Do not submit material you have no right to provide.

External services and website availability

External portals and payment services have their own terms and privacy notices. We do not control external sites or guarantee their availability. We may update, correct, or suspend website functions. Confirm information with us before making a purchasing or operational decision. See our service disclosures for security, recovery, assessment, and support limitations.

Website warranties and liability

To the extent permitted by applicable law, this website and its general informational content are provided on an “as available” basis, without warranties of uninterrupted operation, error-free content, or fitness for a particular purpose. Purchased-service warranties are governed by your written agreement.

To the extent permitted by law, FIX256 is not liable for indirect or consequential losses caused by reliance on general website content or website unavailability. Nothing excludes liability that cannot lawfully be excluded, including fraud or willful misconduct, or limits nonwaivable statutory rights. These terms do not impose a separate liability cap on contracted MSP services.

Law, revisions, and contact

New York law governs these website terms without overriding protections required by applicable law. Disputes remain subject to otherwise applicable jurisdiction and venue rules. These terms do not impose mandatory arbitration or a class-action waiver.
